Use of Force
We live in a complex and dynamic world. The reality is no matter how situationally aware we are, we may find ourselves the subject of a violent encounter. Armed with only a firearm or other defensive weapon is a recipe for criminal charges and civil liability.
In the last four to five years, there has been a significant increase in the amount of people who have sought and obtained their firearm license, and prior to September 1, 2022 New York State law simply required those seeking a firearm license to take a basic firearm safety course.
Although that safety course taught a person how to safely handle a firearm it fell short of teaching people when and under what circumstances they could legally use force. The purpose of this course is to differentiate the different types of use of force and identify the circumstances under which such use may be justified, as specified in Article 35 of the NY Penal Law.
